I accept the bicycle described above has been hired to me for use as a rental bike by Track & Trail Cycle Adventures.

I agree to use it strictly in accordance with the terms of this Bike Hire Agreement. I accept full responsibility for its care and proper use. I have made no misrepresentation on this form or otherwise about my ability and intended use of the bike.

I have received satisfactory answers to all my questions regarding the use and function of this bicycle, including, without limitation, powering on and off, the pedal, gear and braking system and quick release mechanisms.

If at any time I feel the bicycle is not functioning properly, I will stop using it and will return it to the Track & Trail Cycle Adventures for inspection and for any needed repairs or adjustments. I understand that if I fail to return the equipment in satisfactory condition within the prescribed timeframes, I will be liable for up to the full retail value of the equipment.

I understand I am liable in the event the bike is stolen. It is my understanding that I am to secure the bike at all times and not leave it unattended. Further, I understand that the bike’s motor can not be submerged in water (e.g. fording a river or stream) and that dropping the battery will likely result in damage to it.

I understand and am aware that cycling is a hazardous activity, involving inherent and other risks of personal injury or even death. I further understand that injuries in this activity are a common and ordinary occurrence. I freely and knowingly accept and assume these risks.

I understand and have been instructed in the proper use of this bicycle. I have been advised that as a condition of this bicycle being hired to me, I must wear a bicycle helmet at all times while riding it and agree to do so.

I also understand that bicycles are subject to all laws and rules of the road and I agree to abide by them whenever riding on public roadways.

I understand that if I damage other people’s property with the bicycle that has been hired to me, I am liable to the third party for that damage.

I hereby release Track & Trail Cycle Adventures, their representatives, employees and from any and all liability for personal injuries or death, or for any property damages resulting from negligence in the maintenance, adjustment and use of this equipment.

I agree not to make any claim against, or sue, Track & Trail Cycle Adventures, their employees, owners, agents or representatives in the event of injuries or damages relating to cycling and/or use of this bicycle.

Thereby agree to and accept the terms and conditions of this Bike Hire Agreement. There are NO WARRANTIES, express or implied, which extend beyond the description of the bicycle listed above and I accept the hire of this bicycle “AS IS.”

I have carefully read this agreement and fully understand the release of liability provisions it contains. I am aware that this is a release of liability in consideration of this bicycle being hired to me, and I sign it of my own free will.
